What rules can an HOA legally set up?

Homeowners associations (HOAs) often work to create a uniform and appealing neighborhood. Their goal is to maintain high property values and provide amenities for the community. For example, HOAs commonly use membership dues to fund services such as leaf removal, snow removal and the maintenance of community parks, pools or tennis courts.

However, some residents may feel unhappy with the rules they are required to follow. They might even argue that the HOA lacks the authority to impose such rules on them as private homeowners. So, what rules can an HOA legally establish and enforce?

Potential examples

Each HOA is unique, but here are some common examples of rules they may implement:

  • Decoration restrictions: HOAs may set rules regarding holiday decorations, such as when residents can put up Halloween or Christmas decorations and when they must take them down.
  • Architectural controls: HOAs might mandate specific standards for siding, roofing materials, paint colors or repairs to maintain a cohesive appearance throughout the neighborhood.
  • Maintenance standards: Even if a homeowner doesn’t believe certain repairs are necessary, the HOA may require them to make updates or improvements to enhance the neighborhood’s aesthetic appeal and quality.
  • Noise controls: HOAs often establish systems for handling noise complaints or set restrictions on activities residents can engage in outside their homes to minimize disturbances.
  • Home occupancy limits: HOAs may address who can live in a home and how many people can reside there. For instance, many HOAs prohibit renting homes to groups of college students or other short-term renters.

While HOAs are allowed to create and enforce these types of rules, disputes between HOAs and residents are common. It’s important for all parties involved to understand their legal rights and options for resolving conflicts effectively.
